How to get a medical card

West Virginia’s program is run by the Office of Medical Cannabis (OMC), part of the state health department. Here’s the path:

  1. Have a serious medical condition. The list includes cancer, HIV/AIDS, ALS, Parkinson’s, multiple sclerosis, spinal cord damage with intractable spasticity, epilepsy and intractable seizures, neuropathies, Huntington’s, Crohn’s, PTSD, sickle cell anemia, severe chronic or intractable pain, and terminal illness.
  2. Get certified by a physician who is registered with the OMC. Telehealth options are listed on the OMC site.
  3. Apply online with a passport-quality photo, a photo ID, proof of West Virginia residency and your certification. The fee is $50, and a waiver is available for applicants with income under 200% of the federal poverty level.
  4. Wait for review. The OMC reviews applications within 30 days. If you’re approved, you download your digital card.

Cards must be renewed every year with a new physician visit. Patients under 18 need a caregiver, usually a parent or guardian. Recreational users? Err… no.

Where can you buy?

Only at dispensaries licensed by the OMC, which keeps a list on its website. You’ll need your card each time, and the dispensary checks your 30-day allotment in the state tracking system.

West Virginia doesn’t accept medical cards from other states, so visiting patients can’t buy here.

How much can you buy or possess?

Patients can buy up to 6 ounces of flower or 60 grams of concentrate, or a mix of the two, per rolling 30-day period. Your physician can set a lower amount. The rolling part matters: each purchase is added back to your allotment 30 days after the day you bought it, not on the first of the month. For the conversion, the OMC counts 1 gram of processed THC as about 2.835 grams of flower.

Approved forms are pills, oils, topicals, tinctures, liquids, dermal patches, and dry leaf or plant form for vaporizing or nebulizing. Commercially made edibles aren’t on the list. A 2026 bill to add them passed the House but didn’t become law. Patients and caregivers can still mix medical cannabis into food themselves to help with ingestion.

Keep your products in the original dispensary packaging, and carry your ID card whenever you have medical cannabis with you.

Can you grow your own?

No. Only permitted grower/processors can cultivate cannabis. Bills to allow patients to grow at home were introduced in 2026 but didn’t pass.

Where can you smoke?

Nowhere. The Medical Cannabis Act makes it unlawful to smoke medical cannabis. According to the OMC, that means any form of combustion, and using rolling papers, pipes or water pipes is strictly prohibited. You can vaporize flower, which is the approved method, at home. Using it in public isn’t protected.

Can you drive after using?

No. The OMC is clear that medical cannabis patients aren’t exempt from impaired-driving laws. Driving under the influence of any controlled substance is illegal in West Virginia.

Can you take it out of state?

No. The OMC says licensed patients and caregivers are prohibited from traveling outside West Virginia with medical cannabis. Crossing state lines with cannabis is also illegal under federal law. In April 2026, the federal government moved state-licensed medical marijuana to Schedule III, but that doesn’t allow interstate transport. Recreational marijuana remains federally illegal (Schedule I).

Want legal adult-use cannabis? Ohio, Maryland and Virginia allow adult possession. Enjoy it there, and don’t bring it back.

Can your employer fire you?

West Virginia’s medical law offers some protection. Employers generally can’t fire you or refuse to hire you solely because you’re a certified medical cannabis patient. But that protection has limits:

  • Employers can still discipline workers who are impaired on the job.
  • Employers can restrict patients from safety-sensitive tasks.
  • Federally regulated jobs follow federal rules.

Talk to HR before assuming you’re covered.

What are the penalties?

For anyone outside the medical program, according to NORML’s West Virginia summary:

  • Possession of any amount: misdemeanor, 90 days to 6 months in jail and up to a $1,000 fine
  • First offense under 15 grams: the court may grant a conditional discharge, which is probation without a conviction
  • Selling, or possessing with intent to sell: felony, 1 to 5 years and up to $15,000
  • Selling to a minor or near a school: mandatory minimum sentence
