Who can buy?

Here’s the quirky part. In 2021, Virginia became the first Southern state to legalize adult possession, but it never set up legal recreational stores. Lawmakers passed retail bills in 2024 and 2025, and Governor Glenn Youngkin vetoed both. In 2026, under Governor Abigail Spanberger, a compromise passed through the state budget. Recreational sales start July 1, 2027, with up to 350 stores allowed statewide, according to AP reporting.

So in October 2026, who can actually buy legally? Only medical patients. To qualify for the medical program, you must:

  • Be a permanent or temporary Virginia resident
  • Be 18 or older, or have a parent’s or guardian’s consent
  • Get a written certification from a qualified practitioner (a physician, a PA or certain nurse practitioners)

The practitioner decides whether cannabis may help your condition. There’s no set list of conditions. At the dispensary, you show your certification and ID.

Where can you buy?

For now, only at licensed medical dispensaries overseen by the Virginia Cannabis Control Authority (CCA). Pop-up shops, “gifting” setups and unlicensed stores are all illegal. The CCA specifically warns that buying or selling adult-use cannabis isn’t legal yet. When retail opens in 2027, the CCA will license the stores.

How much can you buy or possess?

  • In public: up to 2 ounces (the limit was raised from 1 ounce in 2026)
  • At home: no weight limit for personal use
  • Sharing: adults 21+ can give each other up to 2 ounces, as long as nothing of value changes hands. That means no “free weed with your $50 sticker.”

Hemp shoppers, take note. Since August 15, 2026, a product with more than 2 milligrams of total THC per package can’t be sold as hemp in Virginia, and the CCA now regulates hemp products. Separately, a federal hemp law takes effect on December 11, 2026 and removes legal status from intoxicating hemp-THC products.

Can you grow your own?

Yes. Adults 21 and older can grow up to 4 plants per household at their main home. The rules:

  • Plants can’t be visible from a public place.
  • They must be secured from anyone under 21.
  • Each plant needs a tag with your name, your driver’s license or ID number, and a note that it’s for personal use. The CCA offers a printable tag template.

Where can you smoke?

At home or on private property where the owner allows it. Using cannabis in public brings a $25 civil fine, which rises to $250 on July 1, 2027. Repeat offenses will get stiffer penalties at that point too. Using it while driving or riding in a car is illegal too.

Can you drive after using?

No. Driving under the influence of marijuana is DUI in Virginia. The state has no THC blood limit, so it comes down to evidence of impairment. Open cannabis can’t be in the passenger area of a vehicle, which includes an unlocked glove box. Keep it sealed in the original package or in the trunk. Rideshare and taxi drivers can’t carry cannabis while working.

Can you take it out of state?

No. Crossing state lines with cannabis is illegal under federal law. That’s true even when you’re driving to Maryland or D.C., both of which have legal adult use. Recreational marijuana is still federally illegal (Schedule I). In April 2026, the federal government moved state-licensed medical marijuana to Schedule III, but that doesn’t allow interstate travel.

Heading south? North Carolina and Tennessee both prohibit recreational marijuana, so leave it at home.

Can your employer fire you?

Medical patients get some protection. Under Va. Code § 40.1-27.4, employers can’t punish workers for lawful medical cannabis use, with exceptions. Those exceptions include impairment on the job and situations where following the law would cost the employer federal funding or licensing.

Recreational users have no such protection, so an employer can still keep a drug-free policy for off-duty adult use.

Penalties, briefly

From the CCA and NORML’s Virginia summary:

  • More than 2 oz up to 4 oz in public: $25 civil fine
  • More than 4 oz up to 1 lb in public: misdemeanor
  • More than 1 lb: felony, 1 to 10 years in prison and a fine of up to $250,000
  • More than 4 plants: starts as a civil penalty and rises with repeat offenses or larger grows
  • Under 21: possession is a civil violation, with a fine and a required substance education or treatment program
  • Selling without a license: a crime in any amount
