Wyoming Marijuana Laws (2026): A Beginner’s Guide

Quick answer: Marijuana is illegal in Wyoming for both recreational and medical use, and the state has no medical program. Last verified: October 20, 2026, against the Wyoming Legislature’s statutes (Wyoming Controlled Substances Act, W.S. 35-7-1001 et seq.) and NORML’s Wyoming summary. Laws change, so check the official site before you travel or buy.

Is marijuana legal for anyone in Wyoming?

Short answer: Err… no. Wyoming has no recreational market, no medical program, no dispensaries and no patient cards. Some neighbors have legal cannabis, especially Colorado and Montana, but none of that crosses the border with you.

Wyoming also went its own way on federal rescheduling. In April 2026, the federal government moved state-licensed medical marijuana to Schedule III. Normally, Wyoming’s drug schedules follow federal changes, unless the state formally objects. This time, it did. In July 2026, Wyoming’s Attorney General announced that marijuana stays in Schedule I under state law. The state’s reasoning: the legislature hasn’t created a medical program or recognized other states’ cards, and only the legislature can change marijuana’s status.

Citizen groups have tried to put medical cannabis and decriminalization on the ballot in past election cycles, but none has made it so far. For now, any change would most likely have to come from the legislature.

What about CBD, hemp and delta-8?

Hemp with no more than 0.3% THC is legal in Wyoming, and plain CBD products are widely sold. Intoxicating hemp products are a different story:

  • A 2024 state law bans synthetic THC products made from hemp, such as delta-8.
  • Under the federal hemp law passed in November 2025, intoxicating hemp-THC products such as delta-8 and THCA flower lose their legal status nationwide. The main provisions take effect December 11, 2026.

If a hemp product promises a high, assume it’s not legal in Wyoming.

How much can you possess?

None legally. Here’s how Wyoming grades possession:

  • Up to 3 ounces of marijuana: misdemeanor
  • More than 3 ounces: felony
  • Liquid concentrates (like hash oil): much stricter, so more than 0.3 grams is already a felony

Concentrates, vape cartridges and edibles can land you in felony territory much faster than flower. Don’t assume a small package means a small charge.

Can you grow your own?

No. Cultivating marijuana is illegal in Wyoming. Depending on the amount, it can also lead to manufacturing or intent-to-deliver charges.

Where can you smoke?

Nowhere legally, and Wyoming takes it one step further than most states. Using marijuana or being under the influence of it is itself a misdemeanor, punishable by up to 6 months in jail and a $750 fine. So legally using it in Colorado doesn’t help you if you’re still high when you cross back into Wyoming.

Can you drive after using?

No. Wyoming’s DUI law covers driving under the influence of a controlled substance to a degree that makes you incapable of driving safely. Drivers are deemed to have consented to chemical testing, and refusing has its own consequences. Add possession or under-the-influence charges, and a single traffic stop can stack up quickly.

Can you take it out of state?

No. Crossing state lines with cannabis is illegal under federal law, and bringing it into Wyoming is also a state crime. Recreational marijuana remains federally illegal (Schedule I).

If you want to enjoy legal cannabis, do it where it’s legal and leave it there. Read up on Colorado and Montana before you go.

Can your employer fire you?

Yes. Wyoming has no workplace protections for marijuana use. Employers can test and act on positive results, including results from out-of-state use or hemp products containing THC.

What are the penalties?

According to the Wyoming Controlled Substances Act, as summarized by NORML:

  • Using or being under the influence: misdemeanor, up to 6 months in jail and a $750 fine
  • 3 ounces or less: misdemeanor, up to 12 months and a $1,000 fine
  • More than 3 ounces: felony, up to 5 years and a $10,000 fine
  • Liquid concentrate, 0.3 grams or less: misdemeanor. More than that is a felony.
  • Selling any amount: felony, up to 10 years and a $10,000 fine
  • Selling to a minor: felony, up to 20 years
  • Near a school: an extra $500 fine

First-time offenders may qualify for conditional discharge, which is probation that can keep the conviction off your record if you complete it. For other states, see our marijuana law hub.
