Rhode Island Marijuana Laws (2026): A Beginner’s Guide

Quick answer: Yes. Recreational marijuana is legal in Rhode Island for adults 21 and older, and the state also has a long-running medical program. Adults can carry up to 1 ounce and keep up to 10 ounces at home, and each home can grow three mature and three immature plants.

Last verified: October 20, 2026, against the Rhode Island Cannabis Control Commission and R.I. Gen. Laws § 21-28.11-22. Laws change, so check the official site before you travel or buy.

Who can buy?

Anyone 21 or older with a valid government ID can buy adult-use cannabis in Rhode Island. You don’t have to be a resident. Selling or giving cannabis to anyone under 21 is illegal.

Medical patients register with the Rhode Island Department of Health. Your practitioner signs a certification form that you upload when you apply. The 2022 Cannabis Act eliminated most fees for patients, including registration and renewal fees for patient cards and plant tag fees. Caregiver cards are now handled by the Cannabis Control Commission’s Cannabis Office.

Where can you buy?

Right now, adult-use sales happen at the state’s licensed compassion centers, which are the original medical dispensaries that got hybrid licenses to serve adults. There aren’t many, so lines and limited selection can happen.

That’s about to change. The Cannabis Control Commission (CCC) took over regulation of both adult-use and medical cannabis, and its rules took effect May 1, 2025. The application window for new adult-use retail licenses closes on November 23, 2026, so more shops should open after that. There are no licenses yet for cannabis lounges, so on-site consumption isn’t an option.

How much can you buy or possess?

Under § 21-28.11-22, adults 21 and older can:

  • Possess, use or buy from a licensed retailer up to 1 ounce of cannabis, or the equivalent amount of concentrate
  • Keep up to 10 ounces per resident inside their primary residence, on top of any legal plants
  • Give up to 1 ounce to another adult 21+ for free, as long as the gift isn’t advertised or promoted

Anything kept at home has to follow the CCC’s security requirements. In plain terms, lock it up and keep it away from kids.

Can you grow your own?

Yes. A home can have up to three mature and three immature cannabis plants for personal use. That limit applies per dwelling unit, no matter how many adults live there. You must follow the CCC’s security rules for home grows.

Medical patients and caregivers follow a separate system. They need a Homegrow (Plant Tag) Certificate from the Cannabis Office before they start growing, and renters need a landlord permission form. Medical plant allotments come in sets of one mature and one immature plant.

Where can you smoke?

Mostly at home. The Cannabis Act says nothing in it authorizes smoking or vaping cannabis in any public place. It’s banned anywhere tobacco smoking or vaping is banned, and anywhere a rule or local ordinance bans cannabis. Landlords can prohibit smoking in rentals, and hotels can too. Federal property, including national park land, is off-limits.

Can you drive after using?

Err… No. Driving under the influence of cannabis is illegal in Rhode Island. NORML describes Rhode Island’s drugged-driving law as a strict “zero tolerance” law, with an exception so registered patients aren’t treated as impaired just because metabolites show up in their system. In practice, any THC in your system can cause trouble. Don’t use in the car, keep products sealed, and get a ride if you’ve used. Check the official site for the current testing rules.

Can you take it out of state?

No. Crossing state lines with cannabis is a federal crime. That includes driving to Massachusetts or Connecticut, even though both states are legal and both are only a short drive away. Buy in Rhode Island and use it in Rhode Island.

Federal context as of October 2026: recreational marijuana is still Schedule I. In April 2026, state-licensed medical marijuana and FDA-approved products moved to Schedule III, and broader rescheduling was paused on September 29, 2026.

Can your employer fire you?

Rhode Island offers more protection than many states. According to MPP’s summary of the Cannabis Act, an employer can’t fire or discipline an employee solely for private, lawful cannabis use outside the workplace. Employers can still ban use and impairment at work, and federally regulated jobs, like commercial drivers, still follow federal drug-testing rules. Medical patients have separate protections under the state’s medical law.

Penalties, briefly

  • Up to 1 oz in public, or up to 10 oz per resident at home (21+): legal.
  • Over the limits: charges under the state’s controlled substances act, starting at misdemeanor level. Check the official site for current fine amounts.
  • Selling or growing without a license: prosecuted under the controlled substances act, with felony penalties for larger amounts.
  • A licensee knowingly transferring cannabis to a minor: a felony of up to 5 years and $10,000.

The Cannabis Act also required old possession records for now-legal amounts to be cleared. The Rhode Island Judiciary handles expungement questions.

Hemp note: the CCC is reminding licensees that federal hemp changes take effect December 11, 2026. Under the federal hemp law passed in November 2025, intoxicating hemp-THC products like delta-8 and THCA flower lose their legal status, and hemp products will be limited to 0.4 mg of total THC per container.
