New Jersey Marijuana Laws (2026): A Beginner’s Guide

Quick answer: Yes, cannabis is legal in New Jersey for adults 21 and older, and the state also has a medical program. Adults can possess up to 6 ounces and buy up to 1 ounce per transaction. Home growing is still illegal, even for medical patients.

Last verified: October 20, 2026, against the New Jersey Cannabis Regulatory Commission. Laws change, so check the official site before you travel or buy.

Medical card for visitors Check the CRC; adults 21+ can shop adult-use

Who can buy?

The CRC puts it simply: anyone 21 or older, whether they’re a New Jersey resident or a visitor. You’ll need a government-issued ID. Dispensaries aren’t allowed to copy your ID or keep a record of your purchase beyond what’s needed for the sale. Registered medical patients can shop at medical dispensaries, and medical cannabis is exempt from state sales tax. Under 21? Err… not in the Garden State.

Where can you buy?

Only at dispensaries licensed by the Cannabis Regulatory Commission. The CRC website has a dispensary finder. Many towns have opted out of allowing retail stores, so the nearest shop may be a town or two over. Also check your hemp shelf: a 2026 state law limits intoxicating hemp drinks and products while federal hemp rules change.

How much can you buy or possess?

  • Possession: adults 21+ can have up to 6 ounces of cannabis and cannabis products.
  • Per purchase: up to the equivalent of 1 ounce (28.35 grams) of usable cannabis. That’s 1 ounce of flower, or 4 grams of concentrate, or a mix, such as half an ounce of flower plus 2 grams of concentrate.
  • Gifting: you can give another adult 21+ up to 1 ounce, as long as you don’t take any payment.

Six ounces is a lot of cannabis. If you’re hauling that much around, you might want to rethink your weekend plans.

Can you grow your own?

No. New Jersey is one of the few legal states that still bans home cultivation for everyone, including medical patients. Growing is a crime, and even a few plants can bring serious charges. Several 2026 bills would allow home grow (S2564, for example, proposes 6 plants for adults and 10 for patients), but none had passed as of October 2026.

Where can you smoke?

In private spaces, according to the CRC. The CRC also says cannabis smoking is allowed where cigarette smoking is allowed, unless a rule says otherwise. In practice, the state’s smoke-free laws, local ordinances, landlords, and parks and beaches rules all limit where you can light up, so check local rules before you spark up in public. Landlords can ban use on their property.

New Jersey now has licensed consumption areas too. The first ones were approved in July 2025 and opened that summer. You have to be 21+, they can’t sell food or alcohol, and tobacco isn’t allowed inside. Some let you bring your own cannabis and some don’t, but medical patients can always bring theirs.

Can you drive after using?

No. Driving while impaired by cannabis is a DUI in New Jersey, with the same penalties as drunk driving, including license suspension. There’s no THC blood limit. Police rely on observed driving and drug recognition experts. The CRC’s message is simple: don’t drive high.

Can you take it out of state?

No. The CRC says it directly: it’s still illegal to take cannabis across state lines. That includes New York, even though it’s also legal there, and Pennsylvania and Delaware. It also includes flights out of Newark.

Federal context, as of October 2026: recreational marijuana is still a Schedule I drug federally. In April 2026, state-licensed medical marijuana and FDA-approved products moved to Schedule III, and broader rescheduling was paused on September 29, 2026. A November 2025 federal hemp law takes away legal status from intoxicating hemp-THC products such as delta-8 and THCA flower, with its main provisions taking effect December 11, 2026.

Can your employer fire you?

Not just for legal off-duty use, in most cases. New Jersey has some of the strongest worker protections in the country. Under the CREAMM Act, legal cannabis use generally can’t be the basis for hiring or firing decisions. Employers can still keep a drug-free workplace, ban use on the job, and test workers who seem impaired or are involved in an accident. Those tests include an evaluation by a trained impairment expert. Jobs governed by federal rules, such as commercial drivers, follow federal testing rules.

Penalties, briefly

  • Possessing up to 6 ounces (21+): legal.
  • Possessing more than 6 ounces: this is a fourth-degree crime, with up to 18 months in prison and up to $25,000 in fines.
  • Selling under 1 ounce without a license: a first offense gets a written warning, and later offenses are crimes.
  • Growing cannabis plants: this is a crime, even in small amounts.
  • Under 21: New Jersey uses warnings and parental notification rather than arrests for possession.
