Who can buy?
Any adult 21 or older with a valid government-issued photo ID can shop at a licensed adult-use cannabis store, and that includes visitors. Medical patients with a Maine certification, or a valid one from another state, can also shop at medical dispensaries and registered caregivers.
Maine voters approved legalization in November 2016. Legislators rewrote much of the law before stores opened, and the first adult-use sales happened in October 2020. Maine’s medical program is much older. It dates to 1999, and doctors no longer need to pick from a fixed list of qualifying conditions.
About that repeal effort you might have heard of: a campaign tried to put a measure on the 2026 ballot that would end adult-use sales. It didn’t collect enough signatures in time, so it’s not on Maine’s November 2026 ballot. Supporters have said they may try again for a later election.
Federal reminder: recreational marijuana is still illegal federally (Schedule I). State-licensed medical marijuana moved to Schedule III in April 2026, and broader rescheduling was paused on September 29, 2026.
Where can you buy?
Adults 21+ can buy at licensed adult-use cannabis stores across the state. Patients can use medical dispensaries and registered caregivers, many of which run their own storefronts. Not every town allows cannabis businesses, because Maine municipalities must opt in, so look up locations before you head out.
How much can you buy or possess?
Under 28-B M.R.S. §1501, adults 21 and older can:
- Possess, use or transport up to 2.5 ounces of cannabis, or a combination of cannabis and concentrate that includes no more than 10 grams of concentrate
- Buy up to that same amount from a licensed store
- Gift up to 2.5 ounces to another adult 21+, as long as there’s no payment of any kind, including “donations”
Medical patients can possess more. The law allows up to 8 pounds of harvested cannabis for qualifying patients, mostly to cover homegrown harvests. Note that older state FAQs list a 5-gram concentrate cap; the current statute says 10 grams.
Can you grow your own?
Yes. Each adult 21+ can grow up to 6 mature plants, 12 immature plants and an unlimited number of seedlings. That limit was raised from 3 mature plants in 2023, so older guides are out of date. You can grow where you live, on land you own, or on someone else’s land with their written permission. Plants can’t be visible from a public way without aircraft or binoculars, each plant must be tagged with your name, and you need to take reasonable steps to keep people under 21 away. Medical patients and caregivers follow separate, more generous rules.

Where can you smoke?
Only in a private residence (including the yard or porch) or on private property that isn’t open to the public, where the owner allows it. Public use is a civil violation with a $100 fine. Landlords, hotels and rental companies can ban cannabis on their property. Maine lawmakers left on-site consumption out when they rewrote the voter-approved law, and bills to allow it are still debated. Check the official site before assuming a lounge is legal.
Can you drive after using?
No. Operating under the influence (OUI) covers cannabis in Maine. There’s no set THC number, so officers rely on observed impairment and testing by trained drug recognition experts. Keep cannabis in a closed container away from the driver.
Can you take it out of state?
No. Crossing state lines with cannabis is a federal crime, even into neighboring states that also allow it, like Massachusetts or Vermont. New Hampshire, between Maine and those states, hasn’t legalized adult-use cannabis. Taking it on a ferry, flight or Canadian border crossing is a serious mistake too. Buy in Maine and use it in Maine.
Can your employer fire you?
It depends on your job and your employer’s policy. Maine employers can still ban cannabis at work, enforce drug-free workplace rules and discipline employees who are impaired on the job.
