Who can buy?

Adults 21 and older with valid government ID, residents and visitors alike. Delaware took a slower path than most states. In April 2023, two bills became law without the governor’s signature: HB 1 made possession legal for adults, and HB 2 created the Delaware Marijuana Control Act and a regulated market. Licensed adult-use sales finally began on August 1, 2025, starting at existing medical dispensaries that converted to serve adults.

Delaware’s medical program has existed since 2011. A 2024 law (HB 285) made it much easier to join: doctors can now recommend cannabis for any condition they think it will help, people 65 and older can self-certify, and cards can last one, two or three years.

Federal context: recreational marijuana remains illegal under federal law (Schedule I). In April 2026, state-licensed medical marijuana and FDA-approved products moved to Schedule III, and broader rescheduling was paused on September 29, 2026.

Where can you buy?

At retail stores licensed by the Office of the Marijuana Commissioner (OMC). The first stores were former medical dispensaries; new adult-use licenses are being rolled out more slowly. Counties and towns have zoning control, and some have kept tight limits on where stores can open, so you may need to drive a bit. Only buy from licensed stores.

How much can you buy or possess?

Adults 21 and older can possess, and share for free with another adult, up to:

  • 1 ounce of leaf marijuana, or
  • 12 grams of concentrated cannabis, or
  • cannabis products containing 750 mg of delta-9 THC or less.

That’s the “personal use quantity” in Delaware law. Stores set purchases around it, so check the OMC or ask the store how mixed purchases are counted. Sharing has to be free: selling, even to a friend, requires a license.

Can you grow your own?

Err… no. Delaware’s legalization law does not allow home cultivation, for adults or for medical patients. Only licensed cultivators can grow, and growing at home is still illegal.

Where can you smoke?

Only on private property, and only if the owner allows it. According to the OMC, consuming marijuana in an area open to the public is illegal, and consuming marijuana in a vehicle is illegal too. Public use remains a criminal offense, not just a ticket. Landlords and hotels can ban smoking on their property, and Delaware’s beaches and boardwalks count as public.

Delaware doesn’t license cannabis lounges, so there’s no legal place to consume outside a private residence.

Can you drive after using?

No. Driving under the influence of marijuana is DUI in Delaware, and the state has one of the stricter drugged driving laws in the region. Its “per se” rule makes it a crime to drive with cannabis compounds in your blood within four hours of driving when they result from unlawful use, even without proof of impairment. How courts apply that rule now that adult use is legal hasn’t been settled, so the only safe plan is to never drive after using. When carrying cannabis in a car, keep it in a closed container or out of reach of everyone inside.

Can you take it out of state?

No. Crossing state lines with marijuana is a federal crime, even into adult-use states like Maryland and New Jersey. Delaware is small and many people commute across its borders, so be careful: whatever you buy in Delaware should stay in Delaware. Visiting Delaware with a medical card

Under HB 285, a medical card from another state gives you the same protections as a Delaware cardholder, as long as you would have qualified for a Delaware card. If you’re 21 or older, you can simply shop at an adult-use store.

Can your employer fire you?

For adult use, yes. Delaware’s legalization law lets employers keep drug-free workplace policies and doesn’t protect off-duty recreational use. Registered medical patients have some protection: Delaware’s medical marijuana law bars employers from penalizing a worker just for being a cardholder, though they can still act on use, possession or impairment at work, and federal rules come first for some jobs.

Penalties, briefly

  • More than 1 ounce up to 175 grams: Unclassified misdemeanor, fine of $575 (stiffer if there are aggravating factors).
  • 175 grams or more: Felony, with prison time possible.
  • Under 21 with a personal use quantity: $100 civil penalty for a first offense.
  • Public use or use in a vehicle: Criminal offense.
  • Selling or growing without a license: Criminal charges, with felonies for larger amounts.

About hemp: under the federal hemp law passed in November 2025, intoxicating hemp-THC products like delta-8 and THCA flower lose their legal status, with the main provisions taking effect December 11, 2026. Stick with licensed marijuana stores.
