Louisiana Marijuana Laws (2026): A Beginner’s Guide
Quick answer: Medical marijuana is legal in Louisiana, and any licensed physician or nurse practitioner can recommend it for any condition they think it will help. Recreational use is still illegal. Patients can buy up to 2.5 ounces of raw flower every 14 days, and no one can grow at home. Without a recommendation, 14 grams or less brings a $100 fine with no jail.

Is weed legal in Louisiana?
For patients, yes. Louisiana’s medical program started small, but lawmakers broadened it over several years. Today any authorized clinician can recommend cannabis for any condition they think it will help, and raw flower has been available to patients since 2022. Louisiana doesn’t issue a state ID card. Your clinician sends your recommendation directly to a licensed dispensary.
For recreational users, it’s still no. A 2026 bill to create an adult-use pilot program was pulled by its sponsor, and a resolution to study legalization was deferred. What did pass in 2026 went the other way. House Bill 568 (Act 305) took effect August 1, 2026. It sharply increases penalties for smoking, vaping or “otherwise abusing” cannabis on or within 2,000 feet of school or university property, or on a school bus.
Federal backdrop: in April 2026, federal regulators moved state-licensed medical marijuana to Schedule III. Recreational marijuana is still Schedule I, and broader rescheduling was paused on September 29, 2026.
How to get medical marijuana in Louisiana
- See an authorized clinician. That can be a Louisiana-licensed physician or a nurse practitioner with prescriptive authority, in good standing with their board. Louisiana doesn’t publish a list of recommending clinicians.
- Get a recommendation for a condition the clinician believes cannabis can treat. Louisiana doesn’t limit this to a fixed list.
- Pick a dispensary. Your clinician sends the signed recommendation, on paper or electronically, directly to a licensed dispensary before it can fill your order.
Regulation of medical marijuana dispensaries moved from the Board of Pharmacy to the Louisiana Department of Health on January 1, 2025, so older guides may name the wrong agency.
Where can you buy?
Only at licensed medical marijuana dispensaries, which used to be called pharmacies. Each one is still staffed by a pharmacist, and they’re spread across the state’s regions. You’ll need a valid recommendation on file and photo ID. There are no recreational stores.
How much can you buy or possess?
Patients can buy up to 2.5 ounces (about 71 grams) of raw flower every 14 days. Other products, such as tinctures, edibles, vapes and topicals, follow your recommendation and the dispensary’s rules. Keep everything in its original labeled packaging.
Without a recommendation:
- 14 grams or less: a $100 fine, with no jail time
- More than 14 grams (first offense): up to 6 months in jail and a $500 fine, with higher penalties for repeat offenses
Some cities, like New Orleans, have also passed local ordinances that soften enforcement for small amounts. State law still applies.
Can you grow your own?
No. Only state-licensed cultivators can grow cannabis in Louisiana. Home growing is treated like cultivation for distribution, and those penalties are harsh, with mandatory minimum prison time.
Where can you smoke?
Privately, and carefully. Patients can inhale raw flower, but not in public, and landlords can ban it. Watch out for the new school-zone law. Since August 1, 2026, smoking, vaping or otherwise using cannabis on or within 2,000 feet of a school, college campus or school bus can bring up to a year behind bars and a $1,000 fine. In many cities, 2,000 feet covers a lot of ground, and that includes game days near college stadiums. A separate 2026 law lets terminally ill patients, or their caregivers, possess and use non-smoked medical cannabis in a healthcare facility.
Can you drive after using?
No. Driving while impaired by cannabis is a DWI in Louisiana, whether or not you have a recommendation. Keep your medicine sealed and away from the driver.
Can you take it out of state?
No. Crossing state lines with cannabis is a federal crime. Mississippi and Arkansas have their own medical programs, and Texas has a very limited one, but none of them let you bring Louisiana products in, and Louisiana won’t let you bring theirs back.
Visiting patients can sometimes be served in Louisiana. Under state rules, a non-resident, or someone who has lived here less than 30 days, can show a medical cannabis card from another state. They still need a Louisiana-authorized clinician to send in a recommendation. Rules have changed recently, so confirm with LDH or the dispensary before you travel.
Can your employer fire you?
Usually, yes. Louisiana doesn’t broadly protect medical marijuana patients at work, and employers can enforce drug-free workplace and testing policies. Check your employer’s policy before you start.
What are the penalties?
- 14 g or less, no recommendation: $100 fine, no jail
- More than 14 g, first offense: up to 6 months and $500
- Using near a school or campus (since Aug. 1, 2026): up to 1 year and $1,000
- Selling or growing: felony charges with mandatory minimums
- Paraphernalia: fine only
Hemp products are changing too. Under the federal hemp law passed in November 2025, intoxicating hemp products like delta-8 and THCA flower lose their legal status. The main provisions take effect December 11, 2026.
