Larry L. Moses appeals the denial of his motion for new trial after he was convicted of the malice murder of Marcia Lucille Perry. Finding no error, we affirm.
Appellant was convicted of the murder of Perry on March 16, 1988. He was sentenced to life in prison on April 14, 1988. After his conviction was affirmed by this court in Moses v. State, 259 Ga. 156 (377 SE2d 857) (1989), appellant filed a motion for new trial on April 13, 1990, which was amended on September 13, 1990. The amended motion asserted as newly discovered evidence the fact that a person named Leroy Neal, who was convicted of murder in Alabama, confessed to shooting Perry and that a policeman in Alabama told the author of the confession that Neal’s account was not the truth. The trial court conducted a hearing on the motion and denied it on October 19, 1990. Appellant now appeals the trial court’s denial of his motion for new trial. Held:
