  4. I don’t think you’re misunderstanding the law, I just think you’re underplaying the significance of cannabis being federally legal. Many of the state level Nazi Prohibitionist’s favorite talking point is how bad it would be to legalize at the state level when it’s illegal federally.

    Not to mention the lifting of research restrictions. Also, for those in states where it’s already legal, it will now be 100% legal. I think it’s very fair to say that wiping it from the CSA day one is legalizing it.

  5. All he has to do reassign it from schedule one effectively decriminalizing it federally. It effectively makes it legal in all places that are driven by the federal statues and do not have their own.

  9. Look North to Canada for the positive effect that has resulted from the decriminalization and legalization of marijuana. Just think of the money which would be saved by the federal and state governments in policing. Then think of the economic effects which would be the result of legalization. Marijuana has been unfairly demonized, has resulted in obscene prison time which has resulted in the destruction of many individuals potential futures.
    Reforming the laws in respect to marijuana will have a net positive effect. As a plant it has numerous uses. It can be used for medical purposes, it can be used for fabric, it can be used for animal feed. There are more benefits to legalizing marijuana then there are for it remaining illegal.

    It lays out exactly what the President can do by utilizing the administrative state and enforcing laws that are already on the books, but have never been sunsetted or were just otherwise forgotten about. The President can do these things without Congress's assent and without fear of public scrutiny as acting in a way considered "executive overreach."

He could direct all federal enforcement to desist or make enforcement the lowest priority. Or perhaps he might reclassify hemp to the least restricted drug classification. And some of this would not hold up in court. Some would.

  17. I think you have it close to right. Bernie could change the schedule from 1 to 3 on day one. Now that does not mean you can go down to the drug store and buy it over the counter on day one. Those regulatory issues would still need to be worked out. How it is to be tested and distributed and all that. But what it would do is in states that have legalized the local cops would not be able to get federal cops involved and make arrest under the color of federal law which is what some LEO are doing even in legal states.

  19. Knowing how Bernie Sanders is preparing for literally anything … If he get a plan to legalize Cannabis prior to take office and start that plan on day one, even if the plan itself would take several weeks to be truly effective, it still counts.

  22. Approaches to state laws:

    o Any state that continues to prosecute low level marijuana offenses can no longer access Federal databases for fingerprint checks, criminal backgrounds, etc. DOJ will defer to the states, letting them handle particular non-violent crimes that promise to be expensive to prosecute.

    o Continue to require background checks for employment by companies with Federal contracts, but deny them Federal resources to conduct such checks. Forbid the interstate transfer of such records into such states, forcing them to travel to other states to conduct their background investigations.

    o Forbid Federal LEO's from purchasing firearms and ammunition for work purposes in non-compliant states; a small but symbolic loss of tax revenue.

    o Federal employees within 50 miles of the border are ineligible to in-state meals and lodging reimbursements.

    o Require the TSA to do additional screening of people flying into such states, in order to "respect" their state laws on cannabis. A six-hour screening procedure, maybe. Congress people commuting home are not exempt.

    o For jobs requiring drug testing (eg, under DOT) don't certify labs in the states in question; force the employers to travel (require exorbitant hazmat fees for interstate shipping, including the FAA forbidding them on aircraft). Additional expenses for such testing should not be tax deductible or transferable to the employee; this would encourage the movement of such jobs to other states.

    o For those on bail for Federal offenses or otherwise subject to testing, more aggressive drug testing in those states for opioids on the assumption that people are more likely to abuse them after having to use them in lieu of cannabis for chronic pain conditions.

    o Keep possession of cannabis by LEOs strictly illegal on a Federal level… even if it's tagged as evidence.

    o Permit the sale of cannabis to military dependents on military bases in such states, then let the states try to prevent it from leaving the base. Impeding the flow of traffic will likely piss off the armed gate guards… similarly, explicitly allow cultivation and sales on reservations if the tribal government permits it. The states can't seem to forbid casinos or un-taxed tobacco there, so…

    Some or all of those might have legal difficulties, but would cost the states money to fight. Even with an injunction preventing implementation, the uncertainty would put pressure on the states.

  23. Well they really *shouldn't*, whether or not they could. There has still been no conclusive study into the long-term effects of cannabis use on mental health, and no government should legalize it without first commissioning one and waiting for the results. Anything else would be irresponsible.
