How could the judgement possibly be different if the act of hitting the woman with the broom stick had killed the woman. It is still the same act and the same scenario, only in with a fatal outcome. If there wasn't already a precedent set, they have now set a precedent that could (this next bit is far fetched, but possible) see someone mimic this crime, but instead kill someone with (to keep this in line with this case) a broom stick. Same drug induced mental state, same act, same weapon, different (fatal) outcome Yes I know that if someone planned this it would be a different thing altogether, but a clever person could act their way through the police interrogation and psych evaluations. I don't know enough about law in Canada, but it seems the lawmakers are walking on very dangerous ground. Am I thinking about this wrong?

This is like causing an crash running red light at 200km/h and trying to defend yourself saying you had no intent to cause an accident. Except it works for some reason.
