Thus, could the potential tax evasion be assessed based upon the absolute value of the assets in question irrespective of any other consideration?

She faces no more than one year in jail (not prison), and a fine, if they even charge her at all. Also, I think the charge would be connected to the lack of a business license, and not the pot, but I guess saying that wouldn't be headline-worthy.
